These Terms and Conditions (hereinafter, "T&C") govern access to and use of the real estate crowdlending digital platform operated by Devovix S.R.L., with legal domicile at Av. Libertador 6250, Floor 8, Office B, C1428ARS, Belgrano, Ciudad Autónoma de Buenos Aires, Argentina.
1. Definitions
"Platform": the website devovix.com and all associated applications operated by Devovix S.R.L. "User": any natural or legal person who accesses the Platform. "Investor": a User who makes capital contributions through the Platform. "Project": a real estate development published on the Platform to receive collective financing. "Developer": a natural or legal person responsible for the execution of the real estate Project.
2. Acceptance of Terms
By accessing and using the Platform, you expressly and irrevocably accept these T&C. If you do not agree with any of its points, you must refrain from using the Platform. Devovix reserves the right to modify these T&C at any time, notifying registered Users by email with a minimum notice of 15 calendar days.
3. Registration and User Account
To operate as an Investor, you must create an account providing truthful, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your access credentials and for all activities carried out under your account. Devovix may request additional documentation to verify your identity in accordance with current anti-money laundering and terrorist financing regulations (UIF Res. 30-E/2017 and amendments).
4. Nature of Service
Devovix operates as a collective financing platform authorized by the National Securities Commission (CNV) under Authorization No. 1087/2022. Devovix is NOT a financial entity under Law No. 21,526 and does not offer products or services regulated by the BCRA. Participation in projects through the Platform involves risks inherent to real estate investment, including the possibility of partial or total loss of invested capital.
5. Investments and Risks
All investments made through the Platform carry risks inherent to the real estate market and the nature of crowdlending. Projected returns are estimates and do not constitute a guarantee of results. Devovix does not guarantee the profitability of investments or the successful completion of Projects. Before investing, the User must carefully evaluate the associated risks and, in case of doubt, consult an independent financial advisor.
6. User Obligations
The User agrees to: use the Platform exclusively for lawful purposes; provide truthful and up-to-date information; not carry out activities that may damage, disable, or affect the normal functioning of the Platform; not attempt unauthorized access to Devovix systems; comply with all applicable laws and regulations of the Argentine Republic.
7. Intellectual Property
All content on the Platform, including texts, graphics, logos, icons, images, software, and any other material, is the property of Devovix S.R.L. or its licensors and is protected by Argentine and international intellectual property laws (Law No. 11,723). Its reproduction, distribution, or modification without prior written authorization from Devovix is prohibited.
8. Limitation of Liability
Devovix shall not be liable for direct, indirect, incidental, or consequential damages arising from the use of the Platform or investments made through it, to the maximum extent permitted by current Argentine legislation. In no case shall Devovix's total liability exceed the amount actually invested by the User in the specific Project that is the subject of the claim.
9. Applicable Law and Jurisdiction
These T&C are governed by the laws of the Argentine Republic. For any dispute arising from the interpretation or execution of these T&C, the parties submit to the jurisdiction of the Commercial Courts of the City of Buenos Aires, waiving any other jurisdiction that may correspond to them.
